Nicopure Labs Sues FDA. Think Halo Ecigs!

Well, that didn’t take long! A mere 5 days after the FDA released the Final Rule and subsequently released the PMTA Draft Guidance, Nicopure labs has sued the FDA. The first of numerous law suits I would expect to see. Nicopure is the parent company for the famous Halo Ecigs along with eVo and Purity. The are huge with very deep pockets. In the past, General Counsel and Chief Compliance Officer, Patricia Kovacevic has slanted her blog posts in favor of some aspects of the FDA. She is also responsible for the first successful PMTA like approval when employed in the European Market with another company. It’s clear to this Blogger that they didn’t like what they read from the draconian FDA.

“May 10, 2016 — TAMPA, FL — Nicopure Labs, LLC, the leading manufacturer of American made e-liquids was the first to file suit in the U.S. District Court for the District of Columbia, challenging the FDA’s deeming rule that would subject electronic cigarettes and other vaping products to more onerous restrictions than combustible cigarettes under the Tobacco Control Act.

In its court filing Nicopure Labs, who is not affiliated with any tobacco company, contends the FDA’s rulemaking process violated the Administrative Procedure Act, and that the deeming rule violates the First Amendment to the United States Constitution.”  Read more.
